Limitations and Exclusions

1. Approved System Components
   All components used in the System must be those specified in the GL-TS System Cladding Specification and installed according to the manufacturer’s instructions. The specification must be strictly followed. Any deviation without prior written consent from GL Profiles will void this Guarantee. Note: The GL-TS System Guarantee does not cover workmanship.
2. Exclusions from Coverage
   This Guarantee does not cover failure or damage caused by:
   a. Natural disasters or external forces such as fire, lightning, flooding, explosion, high winds, earthquake, war, riot, civil unrest, radiation, falling objects, vandalism, ground movement, or foundation issues.
   b. Corrosion or degradation resulting from internal building conditions, trapped pollutants, abnormal pollution levels, condensation, or exposure to gases, fumes, or chemicals.
   c. Misuse, negligence, or wilful damage to the System or its components.
   d. Improper installation not in accordance with the GL-TS System Cladding Specification issued by GL Profiles.
   e. Damage occurring before, during, or after installation, including damage during storage or transport.
   f. Dirt or debris accumulation.
   g. Water retention or pooling on roofing or other parts of the System.
   h. Exposure to green, wet, or treated timber.
   i. Any unauthorized modification, extension, or alteration of the System after installation, unless carried out by GL Profiles or an authorized representative.
   j. Post-installation processing, such as bending or profiling.
   k. Loads exceeding those specified in BS639.
   l. Prolonged exposure to temperatures outside –20°C to +60°C.

1. Minimum Claim Value
   GL Profiles will not accept any claims under this Guarantee valued at less than £5,000.
2. Assignment of Guarantee
   This Guarantee may be transferred to a new building owner upon sale, provided GL Profiles is notified in writing. Unauthorised transfers are invalid.
3. Change of Building Use
   Any change in the building’s use invalidates this Guarantee unless GL Profiles gives prior written consent (not to be unreasonably withheld).
4. Effectiveness of the Guarantee
   The Guarantee becomes effective only after GL Profiles has received full payment for the covered components.
5. Local Environmental Conditions
   The Building Owner must inform GL Profiles of any local environmental factors that could adversely affect the System before the Guarantee is registered. Failure to do so will void the Guarantee.
6. Responsibilities Not Covered by Guarantee
   a. This Guarantee does not relieve the building designer from their responsibility to design according to best practices or to inspect construction work.
   b. It does not relieve the Building Owner of their responsibility to perform regular maintenance as outlined in GL Profiles’ Inspection and Maintenance Guide.
7. Coating Exclusions
   This Guarantee does not apply to external coatings. Colorcoat HPS200 Ultra® and Colorcoat Prisma® are covered separately under the Confidex® Guarantee, subject to its registration and terms.
8. Limitation of Liability
   GL Profiles’ sole obligation under this Guarantee is limited to the cost of materials and labour required to restore the defective area to its original guaranteed standard. GL Profiles reserves the right to determine the appropriate remedy. GL Profiles is not liable for indirect losses such as lost profits, revenue, or goodwill, regardless of how such losses arise (including negligence or breach of contract).
9. Claim Procedure
   To make a claim, the Building Owner or their agent must notify GL Profiles in writing within 40 days of discovering the defect and before the Guarantee expires. Claims must include an independent engineer’s report.
10. Entire Agreement
    This Guarantee constitutes the full agreement between the parties.
    a. The Building Owner accepts this Guarantee based solely on its terms and not on any other representation or warranty.
    b. No external standards (British, European, ISO, etc.) shall create additional obligations on GL Profiles unless required by law. It is the Building Owner’s responsibility to ensure the System’s suitability before installation.
    c. This Guarantee does not limit GL Profiles’ liability for death or personal injury due to its negligence or any liability that cannot be legally excluded.
    d. Neither party can claim for misrepresentation not contained in this Guarantee.
    e. This clause does not limit liability for fraudulent misrepresentation.
    f. The Guarantee is only valid once it is registered and officially issued by GL Profiles.
11. Correspondence
    All correspondence related to claims must be submitted in writing to GL Profiles at the address provided.
12. Third Party Rights
    No third party shall have the right to enforce any term of this Guarantee under the Contracts (Rights of Third Parties) Act 1999.
13. Governing Law
    This Guarantee is governed by English law, and any disputes will be subject to the exclusive jurisdiction of the English courts.
